Does my company need to File Taxes this year?
The answer depends on your company’s structure and activity during the prior tax year.
1. LLC – Partnership (Two or More Members)
-
No transactions in the business bank account: No tax filing required.
-
Transactions but no profit: Must file a Business Tax Return.
-
Transactions with profit: Must file both a Business Tax Return and an Individual Tax Return.
Note: “Business bank account” refers to the account opened in the U.S. under your company’s EIN. If you are unsure about your transactions, please contact our Customer Experience team.
2. LLC – Disregarded Entity (Single Member)
The IRS (Internal Revenue Service) generally requires individuals to pay U.S. Income Tax only if they are engaged in trade or business within the country.
Because a Single-Member LLC is taxed at the personal level, if the company has no employees and no physical operations in the U.S., the member may qualify for this exception and might not be required to pay income taxes.
However, it is important to note:
-
Even if no taxes are due, the company must still file Form 5472 + 1120 Proforma every year. Failure to submit these forms can result in penalties of up to $25,000.
-
If the company has transactions, in addition to Business Taxes, the member must also file Individual Taxes.
We strongly recommend reviewing any case that may fall under this exception with a tax specialist, as a detailed analysis of your company’s operations is necessary to confirm whether you are truly exempt from paying income taxes.
3. C-Corporation
-
Regardless of transactions: Must file Business Taxes every year.
-
Personal Taxes: Not required, except when profits are distributed among shareholders.

Required Forms
Our smart form will:
-
Identify all obligations your company may have with the IRS and the state.
-
Indicate which forms must be filed based on your company’s information.
-
Allow you to hire Globalfy to handle the entire filing process.
If you plan to file taxes on your own, we strongly recommend scheduling a call with a tax specialist to ensure the correct forms are submitted.
Does my plan cover Tax Services?
-
Only the Essential and Scale Plans include coverage for the Annual Report (Franchise Tax/State Renewal) and Tax Season services.
-
You will need to activate the service by completing the t form in the platform. Once the form is submitted, we will automatically begin the process for both the Annual Report and Tax Season services.
-
If you have one of these plans, please note that the State fee for the Annual Report is not included. This fee must be paid separately, and the payment will be requested at the end of the form submission process, after you have provided all the required information.
-
Depending on your company’s structure, additional obligations may apply. If these are not covered by your plan, our team will notify you and apply the corresponding charge.
Important: Individual Income Tax must be hired separately, except for Disregarded Entities under the Essential and Scale Plans, where it is already included. If the system indicates you need to file Individual Income Tax, please proceed with the hiring.
