IEEPA Tariff Refunds: How to Request Your Refund

The U.S. Customs and Border Protection (CBP) has officially launched a new process for requesting refunds IEEPA tariffs paid on imported goods. If your company paid these tariffs, you may now be eligible to request a refund, depending on the status of your import entries.



What has changed?

CBP has introduced a new feature called CAPE (Consolidated Administration and Processing of Entries) within the ACE (Automated Commercial Environment) system.

In practice, CAPE was created to simplify the refund claim process. Instead of reviewing each import entry individually, CBP will be able to process eligible refunds on a consolidated basis, including any applicable interest.

How will the implementation work?

The implementation is being rolled out gradually. At this time, only cases included in Phase 1 are eligible, including:

  • Certain unliquidated import entries; and
  • Certain import entries that are within 80 days of liquidation.

CBP has announced that additional phases will be introduced in the future to cover other scenarios.


How to request a refund:

Requesting refunds of IEEPA duties requires:

  1. Importers of Record and authorized Customs brokers must have an established ACE Secure Data Portal account (ACE Portal account).
  2. Recipients use the ACE Portal account to provide CBP with bank account information.
  3. Importers of Record and authorized Customs brokers submit CAPE Declarations in the ACE Portal.

Since eligibility depends on the specific circumstances of each import, we recommend that you also reach out to your customs broker. They will have access to your import history and can confirm which entries are eligible in this first phase, as well as assist you with submitting the request.
